These are the official terms of use ("Terms and Conditions") regarding your use of services and features on www.makeupforever.ca (the "Website") as published and maintained by MAKE UP FOR EVER LLC ("MAKE UP FOR EVER", "We" or "Us"). This Website is intended for residents of Canada over the age of thirteen.

You may be accessing our Website from a computer or mobile phone device and these Terms and Conditions govern your use of the Website and your conduct, regardless of the means of access.

We also like to interact with you on third party sites where we post content or invite your feedback, including sites such as Facebook, Twitter, Instagram, Tumblr and YouTube ("Social Media Sites"). MAKE UP FOR EVER does not control those Social Media Sites and you should always review the terms and conditions posted on Social Media Sites. These Terms and Conditions and our guidelines do not apply to websites or companies that we do not own or control.

By using the Website, you acknowledge and agree to these Terms and Conditions and our Privacy Policy, which is incorporated herein by reference, whether or not you have read them. If you do not agree to these Terms and Conditions, you should not access or use the Website. We may change these Terms and Conditions from time to time. For this reason, We recommend that you regularly check this page to ensure that you have read the most recent version. Such changes are effective when they are posted to the Website and your continued use of the Website after any such changes are posted will be considered acceptance of such changes. The Content (as defined below) presented on this Website is intended for personal, educational or informational purposes only. You should always check the ingredients for products to avoid potential allergic reactions, as MAKE UP FOR EVER may change ingredients from time to time. All products should be used strictly in accordance with their instructions, precautions and guidelines.

2. Product Information and Pricing

We cannot guarantee the accuracy of product images or availability. For example, although We try to accurately display the colours of the products you see on the Website, We cannot guarantee that the colours you see on your monitor will be accurate. Similarly, a product may be sold out or no longer available at a given store, and not available when you arrive. Please call ahead. Any prices on the site are suggested retail prices only. Actual price at a given retailer may vary; retailers may set their own prices. From time to time there may be information on the Website that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, and availability. MAKE UP FOR EVER reserves the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice.

MAKE UP FOR EVER and/or its licensors own all right, title and interest in and to the Website, all design, text, graphics, button icons, images, photographs, audio or video clips, logos, artwork, data, computer code, software and other materials contained or displayed on the Sites ("Content"), as well as the look and feel and the organization of the Content on the Website, including arrangement and compilation thereof (meaning the collection, arrangement and assembly), copyrights, Trademarks (as defined below), patent rights and other intellectual property and proprietary rights therein. Any other use of the Website without the prior written permission of MAKE UP FOR EVER in each instance is strictly prohibited.

The trademarks, logos, service marks and trade names (individually, a "Trademark" and collectively, the "Trademarks") displayed on the Website or on content available through the Website are registered and unregistered Trademarks of MAKE UP FOR EVER and others and may not be used unless authorized by the Trademark owner. MAKE UP FOR EVER will aggressively enforce its intellectual property rights to the fullest extent of the law. You further agree that you may not attempt (or encourage or support anyone else's attempt) to circumvent, reverse engineer, decrypt, or otherwise alter or interfere with the Website and the Content, or make unauthorized use thereof. 6. Accounts, User Comments, Feedback, and Other Submissions

ACCOUNTS

You may have the ability to set up an account (“Account”) on the Website. Always keep your password secure. You are solely responsible for all activity on the Website under your Account. MAKE UP FOR EVER reserves the right to suspend or terminate your Account at any time if it reasonably believes that any activity under your Account violates these Terms and Conditions.

USER CONTENT

Users of our Website may have the opportunity to post certain content, including product reviews on our Ratings & Reviews feature. (collectively "User Materials"). User Materials do not necessarily reflect the views of MAKE UP FOR EVER, and MAKE UP FOR EVER does not guarantee the accuracy, truthfulness or reliability of any User Materials, nor endorse any opinions expressed in any User Materials. MAKE UP FOR EVER assumes no responsibility or liability for, or in connection with, any User Materials. You are solely responsible for any User Materials you post on the Website, and once posted or transmitted, those User Materials cannot always be edited or withdrawn. We cannot be responsible for maintaining any User Materials that you provide to us, and We may delete or destroy any such User Materials at any time in our sole discretion. All User Materials must comply with MAKE UP FOR EVER 's Comment Submission Policy below.

COMMENT SUBMISSION POLICY

MAKE UP FOR EVER encourages User Materials on the Website. You must have an Account to submit User Materials. User Materials are subject to the following rules:

  • Stay on topic and be respectful of others.
  • Never submit anything unlawful, threatening, abusive, harassing, obscene, defamatory, any material that would violate the law or the rights of others, or any material that you know or think might be false, inaccurate or misleading. Please do not post "ad hominem" or personal attacks against other users or MAKE UP FOR EVER employees.
  • Commercial solicitations or advertising for other personal or commercial blogs and websites are not permitted. Repeatedly making the same post in multiple places is not allowed, and links to obscene or offensive sites are strictly prohibited. When in doubt, remember, the Website is a public forum. Use the same judgment and care you would when standing in front of an audience of thousands.

    MAKE UP FOR EVER may, but has no obligation to, monitor and/or moderate User Materials. All User Materials that you submit may be used in MAKE UP FOR EVER 's sole discretion. MAKE UP FOR EVER reserves the right to change, condense or delete any User Materials, or post or not post a review, in its sole discretion. MAKE UP FOR EVER also has the right (but not the obligation) to terminate a registered user's Account or a user’s right to post User Materials to the Website. By submitting any User Materials, you grant Us and our affiliates a royalty-free, unrestricted, worldwide, perpetual, irrevocable, non-exclusive and fully transferable, assignable and sublicensable right and license to use, copy, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, display, make, sell, sublicense, share with our affiliates and export such material (in whole or part) and/or to incorporate it in other works in any form, media, or technology now known or later developed for editorial, commercial, non-commercial, promotional or any other purpose, throughout the world and without compensation to you.     If you access the Website via your mobile device, we do not currently charge for this access. Please be aware that your carrier's normal rates and fees, such as text messaging fees or data charges, will still apply.

We will revoke the use privileges of users who are repeat infringers of intellectual property rights.
